A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
On January 26, 2007, the Defendant was sentenced to imprisonment with prison labor for a maximum of one year and two months for a short term of 10,000 won for special larceny, etc., at the Daegu District Court on January 16, 2009, to imprisonment with prison labor for ten months and fine of 300,000 won for larceny, etc., at the Jeju District Court on July 1, 201, and one year and two months for larceny, etc. at the Jeju District Court on February 14, 2012, and completed the execution of the sentence on December 31, 2012.
1. Around 02:00 on April 24, 2013, the Defendant: (a) discovered that there is a door for the EM520 car parked by the victim D in the 208-dong parking lot of Seongbuk-gu Seoul Metropolitan City, Sungnam-si; and (b) discovered a theft of the victims’ property on a total of four occasions, including the following: (c) up to June 21, 2013 by entering the car into the car, using the keys posted at that place; and (d) using the keys posted at that place, the Defendant stolen the victims’ property from the victims’ property on a total of four occasions, such as the list of crimes.
2. Violation of the Road Traffic Act;
A. On April 24, 2013, at around 02:00, the Defendant driven a car 520 km from the 208-dong parking lot of Sungnam-si, Sungnam-si without obtaining a driver’s license, to the roads in front of the Geum-dong community service center located in Geumdong-dong, Sungnam-gu, Sungnam-gu, and around 02:15 on the same day.
B. On May 6, 2013, at around 02:45, the Defendant, without obtaining a driver’s license on May 6, 2013, driven a GFsta car at the F apartment 114-dong parking lot in Seongbuk-gu, Sungnam-si, Sungnam-si, and around 03:05 on the same day, GaFsta car at around 5 km to the road front of the Geumdong-dong community service center located in Sungnam-gu
다. 피고인은 2013. 6. 21. 02:20경 자동차운전면허를 받지 아니하고 성남시 중원구 H아파트 110동 주차장에서 같은 날 02:30경 성남시 중원구 금광동 26 ‘뿅의 전설’ 음식점 앞 도로까지 I 베라크루즈 승용차를 약 3km 운전하였다.
