A defendant shall be punished by imprisonment with prison labor for four months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On August 2019, the Defendant changed the official document to “E” from “A” to “F” to “F” on July 29, 2015, for the purpose of uttering at the Defendant’s house located in Seocheon-si B and C, the Defendant changed the official document to “01 March 29, 2019” from “O on the date of issuance of the business registration certificate” to “O on March 29, 2019,” and sent a file with the Defendant for production of the Internet homepage as if the file with the changed business registration certificate was issued on September 10, 2019, and had the said G file output and keep the same.
Accordingly, for the purpose of uttering, the defendant altered the business registration certificate under the name of the head of the subsidiary tax office, which is an official document, and exercised the altered official document.
2. On August 2019, the Defendant drafted a “contract for production and installation of a website” using a computer network at the Defendant’s home, and entered “B” personal information as a party to the contract at the end of the contract, and inserted the name of the Defendant F, the Defendant’s private village, and inserted E’s seal thereto. On the same day, around September 10, 2019, the Defendant sent the forged “contract for production and installation of a website” file to G, and had him output and keep the file.
Accordingly, for the purpose of uttering, the Defendant forged “the creation and installation contract on the website” in the name of F, which is a private document on rights and obligations, and used the forged private document.
3. On September 8, 2019, the Defendant, at a coffee shop, where it is impossible to know the trade name on the H 1’s H during the Gyeyang-si period, made the victim G as if he was F, and made a website at KRW 7 million.
