Defendant shall be punished by a fine of KRW 4,000,000.

Punishment of the crime

From December 4, 2017, the Defendant was a soldier in active service from around December 4, 2017, and was discharged from active service on August 10, 2019, and the victim C (20 years of age) was discharged from active service on December 24, 2018, and was a soldier in active service in the above B.

1. 특수협박 피고인은 2019. 3. 21. 08:30경 강원 화천군 소재 B 통합취사장에서 피고인의 후임병인 피해자와 함께 식사 준비를 하던 중 피해자가 점심재료가 아닌 저녁재료를 손질하고 있었다는 이유로 화가 나 피해자에게 “너 진짜 디질래, 당장 점심꺼 썰어야 할 것도 많은데 왜 저녁꺼를 썰고 있냐, 책자 확인 안했냐, 내가 깜박할 것 같으면 수첩에 적으라고 했냐 안했냐”라고 말하면서 위험한 물건인 식칼(총길이 35cm, 칼날길이 25cm)을 들고 식칼의 칼날 끝 부분을 탁자에 4~5회 세게 내리치고, 계속하여 위 식칼을 피해자의 얼굴을 찌를 것처럼 피해자의 얼굴 바로 앞까지 들이밀면서 “내말이 말같이 않냐”고 말하여 피해자를 협박하였다.

2. Cruel acts of exerting power;

A.
