The reasoning of this court concerning this case is as stated in the reasoning of the judgment of the court of first instance except for the deletion of No. 16 of the second judgment of the court of first instance. Thus, it is acceptable to accept this as it is in accordance with the main sentence of Article 420 of the Civil Procedure Act.

2. In conclusion, the plaintiff's claim of this case is justified, and the judgment of the court of first instance is unfair with a different conclusion, but the judgment of the court of first instance cannot be modified disadvantageous to the defendant in this case which only the defendant appealed. Thus, only the defendant's appeal is dismissed. It is so decided as per Disposition.
