A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

[Criminal Power] The Defendant, at the Incheon District Court on June 22, 2017, sentenced ten months of imprisonment for the crime of violation of the Act on the Control of Narcotics, Etc. (the Act on the Control of Narcotics, Etc.) and completed the execution of the sentence at the Incheon Detention Center on January 25, 2018.

[Criminal Facts] The Defendant did not deal with psychotropic drugs, so he did not deal with clickphones (one clickphone; hereinafter “clickphones”), but dealt with clickphones as follows.

1. On September 5, 2018, at around 22:00, the Defendant administered phiphones by inserting the volume of phiphones into a single-use injection machine in Incheon B and the second floor office, dilution them with water, and administering phiphones in a way of injecting them into their arms blood cells.

2. On April 1, 2019, around 15:00, the Defendant administered philophones by inserting approximately 0.03g of philophones into a single-use injection machine and dilution them with water, and administering philophones in a way of injecting them into his arms.

Since the Defendant is not a person handling psychotropic drugs, the Defendant is prohibited from handling the psychotropic drugs-related Mesopha (one philopon; hereinafter referred to as “philopon”).

Nevertheless, around 15:10 on July 2, 2018, the Defendant administered philophones by inserting water into a single-use injection machine with approximately 0.1g of 0.1g of philophones received from F in Michuhol-gu Incheon, Michuhol-gu, Incheon, and crophones in a way of injecting them into their arms and dilution.

The Defendant, along with G, intended to purchase psychotropic drugs from M, the Defendant, at the Defendant’s seat, psychotropic drugs from M, the main body of the Defendant, and purchased six disposable injection equipment, one of which contains approximately 0.7 grams from H in the Defendant’s vehicle parked on the Seo-gu Incheon, Seo-gu, Incheon, on January 31, 2019.

In the end, the Defendant conspired with G to trade approximately 4.2g of philophones.
