A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Defendant is not a narcotics handler.
1. The Defendant in violation of the Act on the Control of Narcotics, etc. (flavoring) asked C to request D to request a cathophone (hereinafter “cathophone”). D, around 17:00 on April 6, 2013, concealed approximately 0.09g of cathophones under the direction of the beer located in the Fmophone room near Busan E, and C, under contact with the Defendant that D left the above cathophones, called the above cathophones and carried approximately 0.09gg of cathophones.
Accordingly, in order to assist the above C in receiving phiphones, the Defendant aided and abetted the act of receiving phiphones by allowing D to put the phiphones into the telephones, thereby facilitating the crime.
2. Around 19:00 on July 7, 2013, the Defendant received approximately 0.03 g of philopon from J from the I in the operation of Defendant in the vicinity of the H Hospital located in G at Silung-si, who violated the Act on the Control of Narcotics, Etc. (1).
(2) The Defendant, at around 10:00 on the day following the date stated in paragraph (1), administered 0.03 grams of philophonephones received from Kmoto G, as described in paragraph (1), in a way of dilution with beerer.
(3) On October 10, 2013, the Defendant received approximately 0.09g of phiphones from J from 1 to 19:00, the Defendant received them.
(4) At around 09:00 the day following the date mentioned in paragraph (3), the Defendant administered approximately 0.03 grams of chophones, among those received from the above Kmophones, as described in paragraph (3), in a way of dilution with beer.
(5) On October 2013, the Defendant provided C with approximately 0.06 gramphonephones in the street around the H Hospital located in G at the end of the night.
(6) On December 2013, 2013, the Defendant purchased approximately 0.7 grams of 1.8 million won on the street near the Busan Coast Guard located in Busan, and 0.7 grams of philophones.
