A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On June 22, 2020, the Defendant: (a) at the Osing room located in Seongbuk-gu, Sungnam-si around 17:50 on June 22, 2020; (b) the Defendant: (c) even though he did not intend or have the intention or ability to pay the amount from the beginning, he was aware that he would pay the amount of the use of the music room normally; and (d) he acquired financial benefits equivalent to that amount by failing to pay the amount of the cost of the use of the music room amounting to KRW 50,000,000 in total, including the amount of KRW 160,000,000, market price of KRW 50,000, market price of which is equivalent to KRW 30,000, market price, and the amount of the cost of the use of the music room.

2. 공무집행방해 피고인은 2020. 6. 22. 21:04경 위와 같이 ‘노래방에서 남성 1명이 술을 먹고 계산을 안 한다'는 112 신고를 받고 출동한 성남수정경찰서 경사 C에 의해 위 성남수정경찰서로 임의동행 되었다가, 같은 날 23:20경 성남시 수정구 성남대로1259 성남수정경찰서에서 조사를 받고 나와 귀가하려던 중, 술에 취한 상태로 경찰서 정문초소 근무에 임하고 있는 의경 D에게 다가가 "내가 조금 전에 경찰서에 핸드폰을 놓고 온 것 같으니 형사에게 알아봐라"고 하며 위 경찰서에 들어가려 하였으나, 위 D가 피고인의 정문 출입을 제지한다는 이유로 화가 나, "가정교육을 그따구로 받았냐! 너 같은 쓰레기가 사니까 나라가 말아먹는다! 개새끼가 버르장 머리가 없네! 너네 부모가 그렇게 가르쳤냐 "고 욕설을 하다가, 계속하여 “확 씨발!”이라고 하며 주먹을 들어 위 D를 때리려는 시늉을 하고, 주먹으로 위 D의 오른쪽 허벅지를 1회 가격하여 폭행하였다.

As a result, the Defendant interfered with the legitimate performance of duties of auxiliary police officers belonging to the Sungnam Police Station concerning the duty of emotional guard.
