The defendant shall be innocent.

1. The summary of the facts charged is a person who actually operates a private teaching institute with the trade name “E” in Busan Jin-gu D.

From August 13, 2013 to September 9, 2013, the Defendant provided 179,000 won for each student in two months from 60 students, 398,000 won in six months, and 549,000 won in English, Chinese, and Japanese language.

Accordingly, the defendant operated a private teaching institute without registering it with the competent authorities.

2. We examine whether the Defendant provided English, Chinese, and Japanese language lessons to 60 students while operating “E” as described in the facts charged.

According to each evidence duly adopted and investigated by this court, the defendant established a coffee manufacturing and ice manufacturing machine, etc. with a camera facility on the second and third floors as stated in the facts charged, and operated a general restaurant with the same trade name as described in the facts charged after installing computers, frackers, reproduction machines, and tableors, etc., and recruited 60 or more members who want to learn English, Japanese language, or Chinese language. The defendant verified the real ability of the members, thereby creating a master group including the original fishermen, and received user fees as described in the facts charged, from Korean language master group. The above frackers were admitted to the Korean language master group with foreigners who want to learn Korean language, and the original citizens need not pay user fees, and the Korean member who is included in the Korean language master group for the original citizens need not pay user fees.

In other words, according to Article 2 subparagraph 1 of the Private Teaching Institutes Act, the above evidence and the records of the instant case are as follows. (1) According to Article 2 subparagraph 1 of the Private Teaching Institutes Act, the teaching curricula for not less than 30 days to the learners or many unspecified and unspecified persons.
