Reasons
1. The Plaintiff filed a payment order (hereinafter “instant payment order”) ordering payment of KRW 1 billion in loan amount against the Gangwon-do residents’ professional axis group (hereinafter “the instant axis group”). The Plaintiff received a payment order (hereinafter “instant payment order”) with the Gangwon-do Government District Court Decision 2013Guj196, and issued a seizure and collection order (hereinafter “the instant collection order”) with the title of execution with regard to the claim for the refund of deposit against Q and R, etc. of the instant axis group as the title of execution with regard to the claim for the refund of deposit against Q and R, etc. of the instant axis group.
The distribution procedure of Q and R et al. Although the Defendants are false wage creditors, they should be excluded from the distribution procedure of the instant case, the instant distribution schedule with the contents of preferential distribution to the Defendants should be corrected to distribute all the dividend amounts of the Defendants to the Plaintiff.
However, in case where the designated parties received dividends in the enforcement procedure, it is unclear whether the designated parties to the lawsuit of demurrer against distribution are the designated parties, and whether the designated parties are the designated parties, and thus, they seek rectification of the instant distribution schedule against Defendant A or the Defendants.
