Reasons
Punishment of the crime
On January 20, 2013, the defendant prepared a false complaint against E and F at the D office where the defendant in Busan Dong-gu, Busan.
The statement of the complaint states "A, the agent of the G insurance agency and the defendant F, who acted as the above agency director, shall delegate all the authority to commission the preparation of a notarial deed to the 3rd floor G insurance agency of the H building in Busan, Busan, on September 30, 2011." The letter of complaint stated "A, the truster on December 25, 201, when the debtor, the debt amount 20 million won, the monetary loan contract for the kinds of debt, the date of the loan, and the date of the loan due on September 5, 2011," with the power of attorney, "A, the truster on December 25, 201, when the period of payment was due on September 5, 2011." The letter of complaint was signed in the name of the complainant A, a private document on rights and duties, and submitted it to the P office and exercised it. It was punished for the defendant."
However, in fact, E/F explained to prepare a notarial deed in the form of money loan for the purpose of securing security in preparation for the time when fees are paid in advance and no insurance contract is maintained after the conclusion of the insurance contract for the defendant who works as an insurance solicitor, and obtained a signature from the defendant in the letter of delegation from the defendant, and obtained the defendant's seal impression on the side of the above name, and thus, it did not forge the power of attorney in the name of the defendant.
Nevertheless, on January 22, 2013, the defendant submitted the above written complaint to the person in charge who is unable to know his name at the Busan District Public Prosecutor's Office's Office which was located in the Busan District Public Prosecutor's Office at the Busan District Public Prosecutor's Office at the Busan District Public Prosecutor's Office.
