1. The Defendant (Counterclaim Defendant) with respect to the Plaintiff (Counterclaim Defendant) A, each of the real estates listed in the separate sheet No. 2, 100/717 shares.

Reasons

A principal lawsuit and a counterclaim shall be deemed simultaneously.

Basic Facts

On August 22, 2005, the Plaintiffs and D, including the sales contract between the Plaintiffs, D and the Defendant, entered into a contract with the Defendant to purchase part of the land of approximately 2,369 square meters in Mari-si (hereinafter “instant land subject to the sale”). The main contents of the contract are as follows.

B and D shall purchase 200/717 shares of each of the land subject to the sale in this case, and the Plaintiff A shall purchase 100/717 shares of each of the land subject to the sale in this case, and the remaining 217/717 shares shall be owned by the Defendant.

In light of the following: (a) the land subject to the instant sale is divided into: (b) the land indicated in the separate sheet Nos. 1 and 3 (hereinafter referred to as “instant land”); (c) the land indicated in the separate sheet Nos. 5 and 703 square meters (hereinafter referred to as “F land before subdivision”) and the written evidence Nos. 3, 703 square meters; (b) on August 22, 2005, the area of the instant land was divided into KRW 738 square meters; (c) the FF land was divided into KRW 703 square meters before subdivision and KRW 35 square meters; and (d) the said division date was four days after the date of the contract; and (e) the said land was divided into KRW 703 square meters after the date of subdivision; and (e) the said parties are deemed to have concluded a sale contract with the boundary of the instant land divided into approximately 603 square meters and thus, the said part of the instant land should be deemed to have been divided into approximately 703 square meters.
