1. Defendant F Co., Ltd.: (a) KRW 4,784,242, and KRW 3,806,008 to Plaintiff B; (b) KRW 3,453,466 to Plaintiff C; and (c) Defendant G.
Reasons
1. The facts below the facts are either in dispute between the parties or in full view of Gap evidence 1-1-4, Gap evidence 3-2, Gap evidence 5-1-2, Eul evidence 5-2, Eul evidence 4-8, Eul evidence 4-1 to 3, witness H, and I's testimony. A. The facts below the facts can be acknowledged in full view of the whole purport of the arguments.
The Defendants are companies engaged in passenger transport business, etc., and Plaintiff A, B, and C are bus engineers belonging to Defendant F Co., Ltd. (hereinafter “Defendant F”), Plaintiff D, and E are respective bus engineers belonging to Defendant G Co., Ltd. (hereinafter “Defendant G”).
B. The terms and conditions of the wage agreement on working hours and overtime allowances belonging to the Defendants and the KMN LU, to which the Plaintiffs belong, have entered into an annual wage agreement. Examining the contents of each of the wage agreement between 2007 and 2010, regarding “working hours and overtime allowances” as follows:
(1) Five day per week is nine hours, including 8 hours of basic work and 1 hours of overtime work, and work hours falling short of or exceeding nine hours during the morning due to the characteristics of operation shall be offset on a monthly basis, instead of calculating on a daily basis, and hours of rest during working hours.
(2) By June 30, 2008, 125% of the Si wage as to the first 4 hours of overtime work of June 30, 2008 and 150% of the Si wage as to the subsequent work hours, respectively, and 150% of the Si wage as to the overtime work from July 1, 2008.
C. The plaintiffs' work types (1) preparation and adjustment (A) preparation and preparation of operation shall be made once a week, and the plaintiffs shall work at the morning and work at the P.M., the plaintiffs shall imprint their seals on the P.M.’s work book before the start of operation after the start of operation, enter their names, routes, IDs, etc. in the deposit sheet, affix them on the bus, affix them on the bus, and commence operation of the bus after entering IDs on the terminal (in the case of an on-the-job work, omitted), and complete operation of the date.
