A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

피고인은 2011. 6. 3. 광주 광산구 장 신로 76 수완 팰리스 빌딩 1 층 우리은행 수완 지점에서 피해자 주식회사 우리은행으로부터 2억 6,500만 원을 대출 받고 2012. 4. 12. 주식회사 D 소유인 감정가 합계 2억 8,113만 원 상당의 머시닝센터 등 기계 5대( 머시닝센터 2대, CNC 밀링 머신 1대, 레 디알 2대 )에 대하여 채권 최고액 2억 8,200만 원으로 하는 근저당권을 설정해 주었고, 2012. 3. 8. 피해자 회사로부터 2억 3,500만 원을 대출 받고 2013. 2. 8. 주식회사 D 소유인 감정가 2억 3,000만 원 상당의 프레스 기계 (SEMI-H TYPE DOUBLE CRANK PRESS)에 채권 최고액 1억 8,000만 원으로 하는 근저당권을 설정해 주었다.

Nevertheless, the Defendant, from October 2015 to December 14, 2015, sold press machinery, which became the object of the right to collateral security, at KRW 150 million, to Dong-dong Co., Ltd., Ltd. on or around December 14, 2015. On January 9, 2014, the Defendant sold at KRW 48,00,000 the machine learning center, which became the object of the right to collateral security, and around February 6, 2016, sold at KRW 85,00,000 to K Co., Ltd., Ltd., which became the object of the right to collateral security.

Accordingly, the defendant concealed his own property, which is the object of the victim's right, and obstructed the victim's exercise of right.
