Defendants shall be punished by imprisonment for two years.

However, the defendants are above 3 years from the date of the final judgment of this case.

Punishment of the crime

1. 피고인들의 공동범행 피고인들은 C, D, E, F, G와 공모하여, 스마트폰 채팅 어플을 이용해 성매수 의사가 있는 남성을 모텔로 유인해 피해 남성을 폭행 또는 협박하여 재물을 강취하기로 계획한 후, G는 스마트폰 채팅 어플 ‘스윗톡’, ‘앙톡’, ‘앙쳇’, ‘원나잇톡’을 이용해 성매수 남성을 물색하고 경찰 등이 오면 알려주도록 망을 보는 역할, F은 성매수 남성을 만나 선불금을 받은 후 모텔로 유인하는 역할, 피고인들과 C, D, E은 모텔 안으로 쳐들어가 피해자를 폭행 또는 협박하여 금원을 빼앗는 역할을 각 담당하기로 하였다.

이에 따라 G는 2019. 3. 31. 오전경 조건만남 어플(앙쳇 또는 스윗톡)을 이용하여 피해자 H(34세)를 광주 서구 I에 있는 J병원 응급실 앞에서 만나기로 하였고, F은 위 병원 응급실 앞에서 피해자를 만나 같은 날 10:30경 광주 서구 K무인텔로 가고, 피고인들과 G, C, D, E은 F이 피해자의 차량에 탄 후 위치추적 어플인 ‘젠리’ 어플을 이용해 피해자의 차량을 미행하면서 위 모텔까지 따라간 후, F은 피해자로부터 선불금을 받고 G에게 ‘L호’라는 문자메시지를 보내자 G는 피고인들, C, D, E에게 안으로 들어가라고 지시하였다.
