1. The Defendants jointly and severally committed against the Plaintiff KRW 27,694,306,459 and KRW 10,000,000 among them, from November 1, 2017.

1. Basic facts

A. On September 19, 2007, Gwangju Bank Co., Ltd. (hereinafter “Magju Bank”), and Han Lan Insurance Co., Ltd. (hereinafter “Korea Commercial and Co., Ltd.”), agreed to lend KRW 80,000,000 to Defendant A Co., Ltd. (hereinafter “Defendant Co., Ltd.”) which newly built a charnel house on the ground of Gyeonggi-si C, and entered into a loan agreement with the Defendants on September 19, 2007 with the following contents. According to the above loan agreement, Gwangju Bank on September 27, 2007 (hereinafter “instant loan”).

B. Unlike the above loan agreement, the Defendant Company did not pay interest during the second interest period (from December 28, 2007 to March 27, 2008) to December 28, 2007, thereby losing the benefit of December 27, 2007.

C. On June 29, 2009, Gwangju Bank transferred the claim for the principal and interest of this case to the Korea Asset Management Corporation, and at that time notified the Defendants of the above transfer.

On August 13, 2009, the Korea Asset Management Corporation transferred the instant principal and interest claim to the Plaintiff. At that time, the Korea Asset Management Corporation notified the Defendants of the said transfer.

As of October 31, 2017, the principal of the instant loan is KRW 10,00,000,000, and overdue interest based on the interest rate for arrears under the above agreement is KRW 17,694,306,459.
