Defendant shall be punished by a fine of KRW 500,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

On September 5, 2018, at around 08:24, the Defendant abused the victim’s face on two occasions on the second floor, who was taking part in the divorce action with the victim D (the 58 years of age) who is a wife in Geumcheon-gu Seoul Metropolitan Government “C” (the 58 years of age) and the 1st floor in which the victim was deprived of the victim’s face.

In light of the following circumstances acknowledged by the evidence duly adopted and investigated by this court, the defendant intentionally spited the victim, as stated in the judgment, although the defendant and his defense counsel could protruding the victim in dialogue, there is no fact that he spits the victim intentionally, and even if the defendant spits it, the above act does not constitute violence. (1) In light of the following circumstances, the defendant intentionally spited the victim as indicated in the judgment.

① 피해자는 수사기관에서부터 이 법정에 이르기까지, “피고인과 2층 사무실에 있었는데 피고인이 사무실에서 나가라고 하여 리프트를 타고 1층으로 내려오던 중 피고인이 쫓아 나오면서 자신을 향해 가래침을 두 번 뱉었다. 당시 입고 있던 하얀 색깔 셔츠 가슴 위에 가래침이 두 군데 묻었고, 그 가래침이 묻은 상태로 1층 사무실에 와서 직원에게 보여 주고 사진을 찍은 다음 112에 신고를 했다. 피고인이 화가 잔뜩 나서 사무실에 쫓아 나오면서 ‘콱’, ‘퉤’ 소리를 내면서 침을 뱉었고 셔츠에 묻어 있는 침도 그냥 침이 아니고 가래침이기 때문에 피고인이 고의로 자신을 향해 침을 뱉었다고 생각한다.”는 취지로 일관되게 진술하였다.
