The defendant is 6% per annum from August 29, 2020 to November 25, 2020, and 4,690,177 won to the plaintiff.
Reasons
1. On October 8, 2015, the Defendant purchased a neighborhood living facility E (hereinafter referred to as “instant shopping mall”) in the Yeongdeungpo-gu Seoul Metropolitan Government D apartment (hereinafter referred to as “instant apartment”) (hereinafter referred to as “instant apartment”) and completed the registration of ownership transfer on August 23, 2018 with respect to the instant shopping mall on the grounds of sale.
Plaintiff
A on August 24, 2018, the Defendant entered into a lease agreement with the object of lease (type of business) as a washing house (hereinafter “instant contract”) from August 24, 2018 to September 30, 2020, on a deposit amount of KRW 50 million, KRW 2.5 million per month, and the period from August 24, 2018 to September 30, 2020, and the rent shall be paid in advance on the 30th day of each month, and the said commercial building was delivered to the Defendant by paying the deposit of KRW 50 million.
Plaintiff
A, after the delivery of the instant commercial building, until October 2018, he/she carried out a laundry construction to operate a laundry in the form of cryman as soon as possible. On October 8, 2018, A opened a laundry store with the trade name of “F store” in the instant commercial building and operated laundry business with Plaintiff B along with the Plaintiff.
On the east side of the instant shopping mall, there exists the entrance of the exclusive parking lot for the occupants of the apartment (hereinafter referred to as the “instant apartment parking lot”) leading to the instant apartment G Dong, and there is a small-scale commercial parking lot for which three vehicles can be parked at a place 70 meters away from the east (hereinafter referred to as the “instant commercial parking lot”), and there is an officetel parking lot for the instant apartment (hereinafter referred to as the “instant officetel parking lot”) at a place 200 meters away from the east side, and if the instant apartment parking lot is parked in the instant officetel parking lot, it should be at least 100 meters if they go to the instant commercial building.
The apartment of this case began to move from June 2018, and entry into the apartment parking lot of this case was made in the early stage of the moving-in.
