1. The Defendant’s KRW 36,368,678 and KRW 9,856,753 among the Plaintiff and KRW 12,661,767 among the Plaintiff.
Reasons
1. Facts of recognition;
A. The relationship between the parties 1) Nonparty C operated a signboard manufacturing factory under the trade name of “E” by leasing the 1st floor building on the D ground of Goyang-gu, Seoyang-gu, Seoyang-gu (Seoul Metropolitan City) (hereinafter the above building is referred to as “E”)
(2) Nonparty F is the owner of the building E. (3) The Plaintiff is the “instant fire insurance contract” along with the G insurance contract (hereinafter “instant fire insurance contract”) that includes the following contents between the Plaintiff and C:
[A) Insurance period: (a) the coverage period from December 16, 2013 to December 16, 2023: Fire damage; (b) the subject-matter of the insurance and the subscription amount: 60 million won of the E building; (c) the machinery of the E building; (d) KRW 90 million of the E building; (e) the equipment of the E building; (e) KRW 10 million of household fixtures; (e) KRW 3 million of movable property; and (g) the insured period from September 15, 2017 to September 15, 202: the coverage period; (b) the subject-matter of the H insurance and the subscription amount: (c) the object of the E building; (e) the installation of the E building; and (e) the installation of the E building; and (g) the neighboring building of KRW 40 million of the E building; and (g) the Defendant’s building of the EM 40 million.
(B) On January 27, 2018, fire and damage occurred in the instant building, which were destroyed by nearby buildings, and the machinery, facilities, office fixtures, fixtures, movables, etc. located in the E and E buildings were damaged by strong fire, its noise, fire-fighting water, etc.
