1. Of the part concerning the principal lawsuit in the judgment of the court of first instance, the Defendant (Counterclaim Plaintiff) who exceeds the following amount ordered to pay.
Reasons
1. Basic facts
A. The Plaintiff is a company with the purpose of planning and selling, trade in, etc., eyebrow and related facilities, contacting, cosmetics containers, and chemical products. The Defendant is a company with the purpose of cosmeticing, cosmetics, electronic equipment sales, trade business, online distribution business ( home shopping and Internet shopping mall operation).
B. On March 21, 2016, the Plaintiff entered into a contract with the Defendant for the provision of production (hereinafter “instant supply contract”) with the content that the Plaintiff’s products are 50% prior to delivery of the products and 50% of the supply price of the products to receive each payment on the end of the following month after delivery (hereinafter “the supply contract”). The Plaintiff entered into a contract for the provision of production (hereinafter “the supply contract”).
C. The Plaintiff supplied goods equivalent to KRW 1,057,394,437 in total to the Defendant from January 18, 2016 to November 30, 2017 (from July 2016, 2016, the Plaintiff supplied finished goods of KRW 1,057,394,437, and thereafter, the Plaintiff supplied the finished goods of KRW 1,057,394,437, and following the agreement between the Plaintiff and the Defendant, “humbrow” products (a product manufactured in accordance with the shape of a person’s eyebrow, which is equipped with the eyebrow material in advance so that the finished goods of the eyebrow can be produced by attaching the eyebrow material, and “humbrow” products separate from the finished goods
A) The Defendant’s supply of the goods amounting to KRW 774,154,059 for the same period, and the goods amounting to KRW 283,240,378 as of November 30, 2017 (243,240,378 among them is the supply price of finished products and inner eyebrows, and the remainder of KRW 40,00,000 is the supply price of eyebrow materials) remains as the outstanding amount.
