A and B shall be punished by imprisonment with prison labor for one year, and by imprisonment with prison labor for one and half years.

Punishment of the crime

1. Defendant A in violation of the Trademark Act is a person who runs the wholesale and retail business of cosmetics from April 2014 to O, a stock company located in the Nam-gu Incheon Metropolitan City N, and Defendant B is a person who manufactures cosmetics in the name of Qu Co., Ltd. located in the Nam-gu Incheon Metropolitan City P, and Defendant C is a person who manufactures cosmetics in the name of Nam-gu R Co., Ltd. located in Incheon Nam-gu, Incheon.

At the above O office around August 2014, the Defendants: (a) Defendant C, from Seoul Cosmetics Co., Ltd., (hereinafter “victim Co., Ltd.”) conspiredd to bring the remainder of the products to Defendant B, Defendant C, Defendant C, and Defendant A, who had the trademark registered with the Korean Intellectual Property Office, to produce diesel (NTURE REPBL REAL REL) under the license of the manufacture of the “NTUBL REL REL REL REL REL”.

As a result, Defendant C and B manufactured, using subsidiary materials, such as diesel raw materials and green plastic containers, fryings, etc., the term “non-designated products” in the above Alway, supplied them to the Korea-Saro bonded warehouse or the above-O office used by Defendant A located in Jung-gu Incheon Metropolitan City, which disguisedly sent them to China. Defendant B produced finished products by attaching a forged Nabble trademark on products sent by A in China, and then shared the role of Defendant B to sell them if the products are transferred to a medium domestic distributor in China.

The Defendants conspired from August 2014 to December 19, 2019 of the same year to manufacture a total of KRW 68,377,280,00 in total of 115,312 market prices of the products that forged “al-ro diesel” registered by the victim company by forging the trademark “al-ro diesel” from around August 2014 to around December 19, 201, and sell approximately KRW 80,00 among them.
