1. The judgment of the court of first instance is modified as follows.

The Defendant’s indemnity amounting to KRW 336,111,730, Oct. 13, 2010, to the Plaintiff.

1. The court's explanation of this case is identical to the reasoning of the judgment of the court of first instance, except for modification or addition as follows. Thus, this is acceptable as it is in accordance with Article 8 (2) of the Administrative Litigation Act and the main sentence of Article 420 of the Civil Procedure Act.

제1심판결 6면 밑에서 2행부터 8면 위에서 9행까지를 아래와 같이 변경함. 『2) 이 사건 2필지의 점유 여부 아래에서는 원고의 감정도 ㉮~㉳ 토지에 대한 점유 여부에 관하여 개별적으로 살펴본다.

가) 감정도 ㉮(보도 부분) : 1993.경부터 1994.경까지 시행된 해군본부~도림로간 도로개설공사 이전부터 보도로 사용되던 곳으로서 원고나 영등포구는 위 보도를 개설한 적이 없고, 원고나 영등포구에서 유지보수 등의 관리를 하고 있지도 않으며, 도로법 제2조 제2항이 정하는 시설 또는 공작물의 범위에 포함된다고 볼 근거도 없다. 따라서 원고가 점유하는 것으로 보기 어렵다. 나) 감정도 ㉯, ㉳(각 조경지 부분) : 영등포구가 녹지대를 조성하기 위해 국방부의 동의를 얻어 잔디를 식재한 곳으로 영등포구가 위 조경지 내 수목을 관리하면서 관련 민원사항을 처리하고 있으며, 도로법 제2조 제2항이 정하는 시설 또는 공작물의 범위에 포함된다고 보기도 어렵다.

Therefore, it is difficult to view that the Plaintiff occupies.

C) Assessment may occur, so far: A road in the form of a road; public announcement of the designation or recognition of a road route under the Road Act; and public announcement of a road zone; or public announcement of the designation of a road zone under the former Urban Planning Act or the former Urban Redevelopment Act shall be subject to the Road Act (see, e.g., Supreme Court Decision 2010Du11849, Sept. 13, 2012). However, as seen earlier, the Seoul Special Metropolitan City Mayor is likely to cause a disaster pursuant to the former Road Act on August 6, 201, and between the Navy headquarters and a forest.
