1. The Defendant: (a) 23,680,00 won to Plaintiff A; (b) 6,760,000 won to Plaintiff B; (c) 7,930,000 won to Plaintiff C and D; and (d) 7,930,000 won to Plaintiff E.
Reasons
1. Details of ruling;
(a) Project approval and public notice - Project name: L Area urban environment rearrangement project (Ij) (hereinafter referred to as the “instant project”) shall fall under the urban renewal acceleration project under the special Act for the promotion of urban renewal.
In an urban renewal acceleration district pursuant to Article 3 (1) of the above Act, the above Act shall take precedence over other Acts.
- Project implementer: Defendant - Public announcement of project approval: Public announcement of approval to implement an urban environment rearrangement project in ML area announced by Jung-gu Seoul Metropolitan Government on December 28, 2015
B. The Seoul Special Metropolitan City Regional Land Tribunal’s ruling of expropriation on January 26, 2018 - A, C, D, E, and F ownership of the Plaintiff subject to expropriation also made a ruling of expropriation. However, the above Plaintiffs withdrawn their application for market price appraisal of obstacles on the ground of the destruction of obstacles caused by removal on February 18, 2019. The purport of the claim and the cause of the claim were to seek an increase in compensation only for the land through the application for change of the purport of the claim and the cause of the claim, and thus, I will examine only the increase in compensation for the land below.
