A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On December 1, 2011, the Defendant was sentenced to one year of imprisonment and a fine of 1,00,000 won in the Suwon District Court for fraud, etc., and completed the execution of the sentence on May 23, 2012 in the Suwon Detention House. On November 7, 2012, the Seoul East East District Court sentenced eight months of imprisonment for fraud at the Seoul East East District Court, and completed the execution of the sentence on March 20, 2013 at Seongdong District Court.

On June 20, 2013, the Defendant: (a) around 22:45, on June 20, 2013, in the E alcohol house operated by the victim D in Young-gu, Suwon-si, Suwon-si; (b) as if he/she would pay the completion; and (c) ordered an alcoholic beverage and a share, but the Defendant did not have any intent or ability to pay the completion amount.

Nevertheless, the Defendant, by deceiving the victim as above, got a total of 205,000 won in the market price from the victim's place, and acquired one of the 17-year two diseases and one of the 17-year one, respectively.

On June 21, 2013, the Defendant: (a) around 03:56 on June 21, 2013, at the H alcohol house operated by the Victim G in Young-gu, Suwon-si, Suwon-si, the Defendant was engaged in as if he/she would pay the completion; and (b) ordered an alcoholic beverage, but the Defendant did not have any intent or ability to pay the completion amount.

Nevertheless, the Defendant, by deceiving the victim as above, obtained from the victim one of the 17-year Scarco 17th century, Macju 2, and Macan 1 from the victim’s place of residence the sum of the market value of which is 188,000 won.

[2013Kadan3669] The Defendant, around 17:00 on June 19, 2013, was engaged in as if the Defendant were to pay the amount at the K cafeteria operated by the Victim J in Suwon-si, Suwon-si, and ordered alcohol and alcohol, but the Defendant did not have any ability or intent to pay the amount.

Nevertheless, the Defendant, by deceiving the victim as above, was provided one time and two times a week to the victim with a total of 36,000 won in the market price in the same place.
