Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On October 24, 2015, the Defendant, without obtaining a driver’s license for a motor vehicle from around 13:50, driven a motor vehicle with approximately KRW 1 kilometer B, which is one kilometer in front of the ancient Cown-gun, in the front of the ancient Cown-gun, the Jin Chang-gun, the Seoul High-gun, Down-gun, which is in the vicinity of the Down-gun, in the front of the Jin Chang-gun, in the same military mountain.

The reason for sentencing under Article 334(1) of the Criminal Procedure Act is that the Defendant, at the Changwon District Court on June 16, 2015, sentenced six months of imprisonment for a violation of the Road Traffic Act (dacting driving) and two years of suspended execution, became final and conclusive on June 24, 2015, and is currently under suspended execution, and that the Defendant repeatedly committed the instant crime despite the fact that the same force was more than once, is a reason for sentencing unfavorable to the Defendant.

In addition, considering the Defendant’s age, sex, motive, means and consequence of the crime, and circumstances after the crime, etc., the sentence of imprisonment with prison labor for six months during which the sentence of the previous suspended sentence is invalidated and the sentence of the previous suspended sentence becomes final and conclusive in the instant case, it seems that this would be excessively harsh. In addition, considering the sentencing conditions stipulated in Article 51 of the Criminal Act, such as the Defendant’s age, sex, motive, means and consequence of the crime, the sentence of a fine like the order shall be imposed. However, the same act would no longer be repeated even once in the future.
