A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 9, 2017, the Defendant came to know the contact point of the victim D (V, 26 years of age) who was a customer at the neighboring club of Mapo-gu Seoul Metropolitan Government Hong-gu to the place, and exchanged contact with the victim. On December 12, 2017, the Defendant provided a drinking again on December 12, 2017.

1. 재물 손괴 피고인은 2017. 12. 13. 03:30 경 서울 마포구 E, 104동 1305호에 있는 피고인의 주거지에서 피해자와 함께 술을 마시던 중, 피해자에게 “ 네 가 마음에 든다, 너랑 사귀고 싶어 ”라고 말을 했으나 피해 자로부터 “ 남자친구와 헤어진지 얼마 되지 않아 사귈 마음이 없다” 는 답변을 듣자 화가 나 피해자가 목에 걸고 있던 피해자 소유인 시가 20만원 상당의 목걸이 1개를 손으로 잡아 뜯은 후 창 밖으로 집어 던져 손괴하였다.

Accordingly, the defendant carried dangerous objects and threatened the victim.
