Defendant
B is the chief vice-chairperson of the Korean Democratic Trade Union F Branch of metal union F (hereinafter referred to as the "labor union") and the defendant A is the head of Trade Union Policy Planning Office and the defendant C is the head of Trade Union Policy Planning Department.
Although labor and F Co., Ltd. had been negotiating wage and collective agreements from May 2016 to May 2017, 2017, there was no consensus between labor and management.
Accordingly, Defendant B and A were willing to occupy the rooftop of the Ulsan City City Council to demand arbitration at the level, such as Ulsan City Council and City Council on the above negotiations and to promote high-quality farming.
1. On May 25, 2017, Defendants B and A, according to the above mother’s joint crime, contacted Defendant C and labor union G, H, I, and J (Suspension of Prosecution on the same day) with Defendant C and labor union members G, H, I, and demanded the transfer of goods necessary for high-quality agriculturality on the rooftop of the building of Ulsan City Council located at the center of Ulsan-gu, Ulsan-gu, the center of which is 201.
On the other hand, the rooftop of the building in Ulsan City, which is managed by the Ulsan City City, is a place where the passage of the general public is strictly controlled by the entry card of public officials for the purpose of building management.
With the aim of enabling Defendant B and A to occupy the rooftop of the Ulsan City City Council without obtaining permission from the injured party, the Defendants divided the goods necessary for high agriculturality, such as 14:40 on the same day, and divided them into three goods necessary for high agriculturality, such as tents, raw water, placards, and gasoline, and install tents and banners at the same place, and Defendant C shall enter the City Council’s related persons, etc., with access to the City Council.
In order to threaten, gasoline was spreaded on the floor of rooftops.
Accordingly, the Defendants intruded on the rooftop of the Ulsan City Council jointly with the Labor Lighting G, H, I, and J.
2. A person who intends to hold an outdoor assembly or demonstration for a joint crime committed by Defendant B or A shall state his purpose, date, time, place, etc.
