1. The Plaintiff:
A. As to the Defendant A’s KRW 238,396,854 and KRW 82,024,252 among them, the Defendant A shall be from August 20, 1992 to KRW 119,46.
Reasons
1. Basic facts
A. On July 31, 1991, the Korea Credit Guarantee Fund entered into a credit guarantee agreement with Defendant A on July 1992 with respect to the discounted bill funds 1,00,000,000,000 and its subordinate debts (hereinafter “first loan”) that Defendant A borrowed from a commercial bank (hereinafter “second loan”), with the term of guarantee specified on July 19, 1992, and the credit guarantee agreement with Defendant A on October 31, 191, with respect to the discounted bill funds 200,000,000,000, and its subordinate debts (hereinafter “second loan”), respectively, with the term of guarantee specified on September 11, 1992, and F jointly and severally guaranteed the liability for indemnity under each credit guarantee agreement with Defendant A Credit Guarantee Fund.
B. The Credit Guarantee Fund subrogated each of the Defendant A’s loan obligations on August 20, 1992, and September 16, 1992, in accordance with the respective credit guarantee agreements.
C. On the other hand, the Credit Guarantee Fund shall be the same 1.B.
As described in the subsection (d), Defendant C, B, and G were issued by each of the Defendant A’s obligations on behalf of each of the Defendant A, as described in the separate sheet of notes issued by the Commercial Bank and Choung Bank, and 7 promissory notes endorsedd by the Defendant A, Commercial Bank, and Choung Bank were endorsed and transferred.
1. The Credit Guarantee Fund shall bring a civil action against Defendant A, C, B, and F in which it claims the amount of reimbursement from the same court under the Seoul District Court95Kadan63961, and against the Plaintiff on August 24, 1995:
A. Defendant A and F jointly and severally agreed 238,396,854 won and 82,024,252 won from August 20, 1992; 219,416,403 won with 21% per annum from September 16, 1992 to February 28, 193; 20% per annum from the next day to July 31, 1993; and 17% per annum from the next day to the date of full payment;
B. Defendant C shall pay 107,358,000 won and the amount at each rate of 6% per annum from the corresponding maturity date to July 8, 1995, and 17% per annum from the following day to the date of full payment in the separate sheet.
