Punishment of the crime

On January 2, 2017, at around 02:25, the Defendant discovered the victim E (n, 21 years old) who was divingd at the dumbing room in Suwon-si C located in Suwon-gu, Suwon-si, and found the victim's hand in the part of the victim, added the victim's hand to the part of the victim, and made the victim forced the victim to commit an indecent act by force, by taking the victim's hand from the victim's hand.

그러나 위 증거들에 의하면, ① 피해자는 위 범행 시점으로부터 6개월이 지난 이 법정 증언 시까지 도 바지 아래에서 피부와 피부가 맞닿는 느낌이 있었다는 점을 선명하게 기억하고 있고, 자신의 바지 안에서 손을 끌어올려 보니 피고인의 손이었으며 그 손이 이어 피해자의 허리를 감쌌다는 경위까지 구체적으로 기억하고 있는 점, ② 피해자가 이 법정에서 피고인이 음부까지 더듬었는지는 명확히 기억하지 못하나, 피고인이 피해자의 음부 부위를 만졌다는 것 자체는 부인하지 않고 있고, 피해자가 이 사건 신고 직후 피고인이 피해자의 바지 속으로 손을 집어 넣어 음부까지 만졌다는 사실을 수사기관에 구체적으로 진술하였던 점, ③ 피해자는 이 사건 직후 여성 친구인 F에게 ‘ 허벅지 사이에 피고인의 손이 들어가 음부 부위까지 올라가고 피해 자가 피고인의 손을 뿌리쳤을 때 허리로 손이 이동하여 더듬었다.
