1. The defendant A shall be punished by imprisonment for six months, and the defendant B shall be punished by a fine of three thousand won.

2. Defendant B is the above fine.

Punishment of the crime

1. Defendant A

A. On April 15, 2016, around 07:30 on April 15, 2016, the Defendant opened a door by dividing the password already known to the office, and intruded into the office. Around 07:30, the Defendant used one set of LG “X-note” in the victim E-owned market value equivalent to KRW 350,000,000, and stolen it.

B. On April 25, 2016, at around 06:00, the Defendant opened an entrance as a key in the “D” office located in the Daegu Suwon-gu F, Daegu Suwon-gu F, and intruded into the office. The Defendant had one of the two computers owned by the victim G, which was located on his/her book, owned by the victim G, with a total of KRW 600,000, and stolen it.

2. Defendant B

A. On April 15, 2016, the Defendant: (a) around 07:30 on April 15, 201, from “I” operated by the Defendant located in Jung-gu Daegu-gu, Daegu-gu, as “I” to “A”

As in the same paragraph, LG “X-note” was purchased from one Nowon-gu.

In such cases, the Defendant, who is engaged in the business of selling used electronic and electronic equipment, has a duty of care to verify whether the goods are stolen by ascertaining the personal information of the above A, and by examining the process of acquisition of electronic and electronic equipment, motive for sales, and the appropriate price at the time of transactions.

Nevertheless, the Defendant neglected such care and acquired stolens by purchasing one of the above LG “X-note” 70,000 won from the price by negligence while neglecting the judgment on the stolens.

B. On April 25, 2016, the Defendant around 10:00, at the same place as above, A-B.

As stated in paragraph (1), one computer and one monitor were purchased.

In such cases, the defendant, who is engaged in the sales business of used electronic and electronic equipment, has a duty of care to verify whether he/she is stolen by ascertaining the above A's personal information, and by examining the process of acquisition of electronic equipment, motive for the sale, and the appropriate price at the time of transaction.

Nevertheless, it is not possible.
