Defendants shall be punished by a fine of KRW 5,000,000.

Punishment of the crime

1. Defendant A is a director in-house director of a stock company B who engages in food processing and manufacturing business, etc. in C in chronological City.

(a) Any person who intends to conduct a business subdividing food and drugs shall report to the Minister of Food and Drug Safety or a Metropolitan Autonomous City Mayor, a Metropolitan Autonomous City Mayor, a Special Self-Governing Province Governor, or the head of a Gun/Gu, as prescribed by Presidential Decree;

Nevertheless, the Defendant, without reporting to the competent authorities from July 2017 to November 15, 2017, operated a food subdivision business by subdividing it into 10 g or 1 kg, which is supplied by F Co., Ltd. located in Asan-si E from the above Co., Ltd. to November 15, 2017.

(b) No person shall sell products manufactured, processed, or subdivided by any person, other than a business operator, or collect, manufacture, import, process, use, cook, store, subdivide, transport or display them for sale;

Nevertheless, from early July 2017 to November 15, 2017, the Defendant supplied 332 km (dried soft Sheet 288km, dried 14.5 km, dried Doz 19.5 km, dried Doz 19.5 km) manufactured by the F Co., Ltd. located in Asan-si E, which is not a food manufacturing processing business operator, in the above Co., Ltd. B, and sold 10 g or 1k g for sale to many unspecified buyers, and then subdivided it into 10 g or 1k g for sale.

2. Defendant B, at the time and place specified in paragraph 1, the Defendant, a representative of the Defendant, committed an act of violation as described in paragraph 1(a) and (b) with respect to the Defendant’s business.
