1. Defendant C shall pay to the Plaintiff KRW 71,350,000 and the interest rate of KRW 15% per annum from November 26, 2016 to the date of full payment.
Reasons
1. Basic facts
A. On April 11, 2013, the Plaintiff lent KRW 150 million to the Defendant Company, and paid KRW 135 million after deducting KRW 15 million as interest. (2) On May 2, 2013, the Plaintiff loaned KRW 200 million to Defendant C with a 2% amount agreed upon, and paid the remainder KRW 190 million after deducting KRW 10 million as interest.
B. On May 7, 2013, the Plaintiff sent e-mail to the Defendant C, a de facto manager of the Defendant Company, stating that “The amount of principal KRW 12.5 million per month, interest KRW 1,437,500 per month, in relation to the Defendant Company’s loans, shall be paid in equal amount to KRW 13,937,500 per month.” (2) The Defendant Company’s accounting division of the Defendant Company D and the Defendant C paid KRW 272,325,00 as indicated below (hereinafter “the instant repayment details”) to the Plaintiff under their own account or the Defendant Company’s name.
