Defendant shall be punished by a fine of KRW 2,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. At around 13:10 on June 21, 2014, the Defendant stolen, with a copy of KBN’s National Card, which is owned by the victim E, who was located on the floor of this area, at a joint resting room in Dongjak-gu Seoul Metropolitan Government, with a total of KRW 9.80,00,000, the market value of the victim E-owned.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. On June 21, 2014, at around 13:28, the Defendant: (a) presented to the victim, as if he had a legitimate right to use the said E’s KB national card that was stolen from E, as described in paragraph (1) of the said Article, purchased YM at the “H” store operated by the victim G located in Dongjak-gu Seoul Metropolitan Government F; (b) obtained from the victim, and wrongfully acquired 12,000 won of the market price from the victim, and wrongfully used the stolen credit card.
B. On June 21, 2014, at around 13:32, 2014, the Defendant: (a) purchased an inferior article at an “I department store” store located in Dongjak-gu Seoul Metropolitan Government F; and (b) presented the KB national card in the above E name, which was stolen from E, as described in paragraph (1), and presented it to the victim who was an employee of the said store, as if he/she had legitimate right to use; and (c) acquired the goods from the victim and acquired the stolen credit card amounting to KRW 20,00 in the market price;
C. On June 21, 2014, at around 13:46, the Defendant: (a) presented to the victim K, an employee of the said store, as if he/she had been duly entitled to use the said E’s KB national card that was stolen from E, as described in the foregoing paragraph (1), at the store of “J” in the Dongjak-gu Seoul Metropolitan Government F; (b) obtained from the victim 1,150,000 KRW 2,150,000 of the market price; and (c) wrongfully obtained from the victim 1,20,000 KRW 1,20,000 of Samsung TT North Korea and the market price; and (d) unlawfully used the stolen credit card.
The Defendant is in the Dongjak-gu Seoul Metropolitan Government F on June 21, 2014.
