Defendant shall be punished by imprisonment for a year and February of one year and a fine of KRW 5,00,00.

The defendant does not pay the above fine.

Punishment of the crime

[2015 Highest 1640] On August 12, 2013, the Defendant made a false statement to the victim E by phone call from the D office in the Defendant’s operation of the Defendant located in Kimhae-si, Kimhae-si, that “on the delivery of iron plates, the price will be paid immediately after the processing.”

However, in fact, the amount of money borrowed at the time is equivalent to 70 million won, and because it was not supplied to an existing business entity due to its failure to pay the price, it was requested to the victim for the supply, and even if the unpaid amount of goods is supplied by the victim, there was no intention or ability to pay the price.

As such, the Defendant, by deceiving the victim as such, obtained from the victim the supply of KS-3 iron plates and SCR 440 transshipment materials equivalent to the market price of KRW 9,926,620 from August 12, 2013 to January 2, 2014, and acquired them by deception.

[2015 Highest 1690] Around April 30, 2014, the Defendant entered into a lease agreement with the D plant operated by the Defendant in Kimhae-si, and with the victim free capital stock company, one unit of CNC Line ( were manufactured in Japan, 1987 formula) and one unit of the crime charter (20 million won in Japan, 190,000,000 won in total, and the lease period: 36 months, 4,379,60 won in total: 4,60 won in total, and 36 months: 60 won in total, and kept the said lease articles for the victim company.

Around September 1, 2014, the Defendant sold the leased article to a person who was unaware of his name at the above factory and embezzled it.

[2015 Highest 2293] The defendant is a representative of D in the Kimhae-si F, who operates a manufacturing business with three full-time workers.

The Defendant, while working in the foregoing workplace on September 3, 2014, did not pay the total of KRW 6,974,180, and the total of KRW 8,729,150 to retired workers H on July 31, 2014, within 14 days from the date of retirement, without any agreement on the extension of the due date.
