가. 피고인은 2012년 9월 초순 일자불상 03:00경 위 제1항과 같은 피고인의 주거지 거실에서 피해자 G(여, 15세)에게 술을 마시면서 놀자고 집으로 데려와서 거실에 있는 침대에서 자라고 안심시킨 다음 잠을 자려고 침대에 누운 피해자 옆에 누워 손으로 피해자의 몸을 더듬다가, 피해자가 “뭐하는 짓이냐. 너 머리에 똥찼냐”라고 욕을 하고 양손으로 밀치며 반항하자 손가락 3개를 피해자의 입에 넣어 소리를 지르지 못하게 하고, 피해자의 몸 위에 올라타 피해자의 양팔과 상체를 눌러 움직이지 못하게 하는 등 반항하지 못하게 한 후 항거불능 상태에 빠진 청소년인 피해자를 1회 간음하여 강간하였다.
