A and B shall be punished by imprisonment for one year, and by imprisonment for six months, respectively.

Punishment of the crime

1. No person, other than Defendant A and Defendant B, shall engage in any conduct similar to the riding voting in connection with a racing conducted by a marina society, in paying property or property benefits to the enemy;

Nevertheless, on November 2014, Defendant A leased a private horse site (G, H, I, and J) to pay KRW 500,000 per month from the person in whose name the horse site was in fact, and thereafter, Defendant A, in real time, operated a horse game held in the Morse society in Korea and paid dividends to the enemy according to the ratio of distribution, has overall control over the management of members and revenue management of the above site, and Defendant B conspired to charge and exchange game money while managing the above site.

As seen above, Defendant B conspired from November 2014 to April 2015: (a) from April 201, 2015 to April 2015, Defendant B operated the above private horse site from April 201 to September 2015; (b) received dividends of KRW 129,129,000 in total from members to the post office account (N) in the name of M; and (c) paid dividends of KRW 69,794,30 in total, KRW 685,645,216 in the name of the O bank account; and (d) paid dividends of KRW 57,794,645,616 in total, KRW 585,60,00 in total, KRW 200 in the name of the member; and (e) paid dividends of KRW 129,129,00 in the name of the member.

As a result, the Defendants conspired to commit an act similar to the riding voting in relation to the racing conducted by a marina society, thereby paying property or financial benefits to the enemy.

2. Defendant C provided the said private horse site operated by Q from May 2015 to July 2015 to customers, and received from Q to receive 120% of the input amount from Q in return, and paid 10% of the input amount if all money was lost.
