Punishment of the crime

The Defendant is a person who runs a company E (the name of November 28, 201, changed to F, Co., Ltd., Ltd.; hereinafter “E” or “F”; and the part of “stock company” among the name of the company is omitted) that mainly engaged in wholesale business in the Nam-gu Incheon Metropolitan City Dtel A. 308.

1. Crimes of January 2012;

가. 피고인은 영리를 목적으로 2012. 1. 18.경 위 E 사무실에서, 사실은 E가 G으로부터 은 그래뉼(Granule)을 공급받은 사실이 없음에도 공급가액 54,400,000원 상당의 세금계산서 1매를 발급받은 것을 비롯하여 그 무렵부터 2012. 6. 14.경까지 별지 범죄일람표 1 기재와 같이 G, H로부터 공급가액 합계 3,923,710,000원 상당의 허위 매입세금계산서 60매를 발급받았다.

나. 피고인은 영리를 목적으로 2012. 1. 5.경 위 E 사무실에서, 사실은 E가 H에 은 그래뉼을 공급한 사실이 없음에도 공급가액 53,350,000원 상당의 허위 매출세금계산서 1매를 발급하였다.

2. 2012년 2기 범행 피고인은 영리를 목적으로 2012. 9. 13.경 위 E 사무실에서, 사실은 E가 H로부터 은 그래뉼을 공급받은 사실이 없음에도 공급가액 46,200,000원 상당의 세금계산서 1매를 발급받은 것을 비롯하여 그 무렵부터 2012. 12. 27.경까지 별지 범죄일람표 2 기재와 같이 H, I로부터 공급가액 합계 3,374,880,000원 상당의 허위 매입세금계산서 20매를 발급받았다.

3. Accordingly, the Defendant received or issued a false tax invoice for each seller or seller equivalent to KRW 7,351,940,000 in total value of supply without supplying or not supplying goods or services for profit-making purposes.
