피고인은 2014. 8. 7. 21:20경 서울 동작구 국사봉1길 3 소재 국민은행 앞 노상에서 G 그랜드카니발 차량을 주차하려고 하는 피해자 H에게 다가가 행인 등 불특정 다수인이 보는 앞에서 창문을 손바닥으로 수회 치고 조수석문을 강제로 열려고 하면서 조수석에 침을 뱉고 "야, 씨발 년아, 너 내려 봐, 너 내려 개 같은 년아, 이런 씨발 년이 있나, 야 이 개 같은 년아, 썅년아 내려, 개 같은 년"라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
