피고인들은 2017. 5. 19. 10:00 경 경산시 E에 있는 피해자 D(67 세) 가 운영하는 F 식당 전용 주차장에서, 피고인 A은 G 아반 떼 승용차의 운전석에, 피고인 B은 위 승용차의 조수석에 탑승하여 위 아반 떼 승용차의 시동을 켠 채 주차하고 있던 중 피해 자로부터 “ 차량을 식당 앞 전용 주차장으로 이동을 하던지 시동을 꺼 달라” 는 말을 듣자 화가 나 피해자와 말다툼을 하게 되었다.
