Punishment of the crime

The Defendants, who were in charge of the president, directors, and general affairs of the I Apartment Housing Residents' Representative Council, were in charge of the Defendants’ general affairs from around July 1, 2009 to June 30, 2015, Defendant G was in charge of the duties of president from around June 30, 2015, Defendant B was in charge of the duties of president for the same period, Defendant C was in charge of the duties of directors for the same period, Defendant C and Defendant D were in charge of the audit for the same period, Defendant F, and Defendant J were in charge of the duties of directors from around July 1, 2013 to June 30, 2015.

According to the "Rules on Management of Multi-Family Housing" of the above apartment, the "operating expenses" shall be used only as operating expenses of the representative meeting of occupants designated under the above Rules, including educational expenses, meeting attendance allowances, the expenses for the promotion of duties of the chairperson and the general affairs in connection with the operation of the representative meeting of occupants.

However, while the defendants kept the operating expenses of the above tenant representative meeting, which is the owner of the above tenant's apartment as the victims (the defendant G, the general secretary, was kept in the course of business), the defendants conspired to use the operating expenses for any purpose other than those designated in the above rules.

G, A, B, C, and D used the “L” house located in G on July 19, 201 at Sungsung City around 19, 201, as well as 64,500 won at his/her own expense. From that point to June 27, 2015, the said Defendants consumed KRW 12,579,760 in total on 112 occasions in the same manner as written in the daily list of crimes in the attached Table from that point to June 27, 2015.

F and E have voluntarily consumed KRW 6,729,40 in total over 51 times from July 19, 2013 to June 27, 2015, including the contents indicated in No. 629,00 per annum of the crime concerned from July 19, 2013 to June 27, 2015.

As above, Defendant G, B, C, and D conspired from July 19, 201 to June 27, 2015, Defendant F, and E embezzled the victims’ property from July 19, 2013 to June 27, 2015.
