1. The Defendant’s KRW 50,000,000 as well as the annual rate of KRW 5% from March 22, 2016 to June 28, 2019, and the following.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Articles 257 (1) and 208 (3) 1 of the Civil Procedure Act of the applicable provisions of Acts;
3. As the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings were amended on May 21, 2019 and enforced on June 1, 2019, since the statutory interest rate under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings was 12% per annum from June 1, 2019, it is recognized only as damages for delay calculated at the rate of 12% per annum from June 1, 2019, and the exceeding part of the claim is dismissed.
