Reasons
Punishment of the crime
[criminal history] On November 4, 2016, the Defendant was sentenced to one year of imprisonment due to fraud, etc. at the Suwon Franchi, and completed the execution of the sentence in the third intersection of North Korea on May 26, 2017.
[Criminal facts]
1. The Defendant committed the crime in “C” was committed in the second room of “C” operated by the victim E on August 2, 2017, whose level of alcohol was around 21:00, Ansan-si and the third floor D, Ansan-si, and the Defendant did not pay the amount, even though he was provided with 15 C C, the sum of which is equivalent to KRW 335,00,000 in the market price, and the Defendant was provided with 335,000,000 won in total from the victim.
2. On August 3, 2017, the Defendant committed a crime in “F”: (a) around 02:30 on August 3, 2017, in the “F” operated by Ansan-si member G and the victim H on the first floor; (b) was committed as if he did not have an intent or ability to pay the drinking value and would normally pay the drinking value; and (c) was provided with ten (10) minutes service from the injured party, which is equivalent to the total market value of KRW 60,00,00, and did not pay the said value.
3. At around 05:20 on August 3, 2017, the Defendant committed the crime in “I”, the number 7 “I” operated by Ansan-si J and the victim K on the first underground floor of Ansan-si, the Defendant was engaged in as if he would normally pay the alcohol value despite having no intent or ability to pay the alcohol value, and even if he was provided with the service of KRW 260,000 in total from the damaged party, the Defendant did not pay the alcohol value.
Accordingly, the defendant, by deceiving the victims, received beer equivalent to KRW 655,00, or acquired pecuniary benefits equivalent to service charges such as entertainment receptioners.
