The judgment of the court below is reversed.
The defendant shall be innocent.
Reasons
1. The gist of the grounds for appeal is that the Defendant committed an indecent act, such as taking custody of the victim’s her butt her, while committing an indecent act.
2. Determination
A. On August 7, 2018, the Defendant: (a) around 12:30 on August 7, 2018, at the entrance of the “C” officetel sales office located on the 1st floor of the Gangnam-gu Seoul building building B, visited the customer at the entrance of the right model house located on the 1st floor of the building B, and (b) stated the victim as “drawer than this day’s name, leisure, 48 years old; and (c) took a control of the victim’s right her hand, thereby committing an indecent act by force against the victim.
B. The lower court found the Defendant guilty of the instant facts charged by adopting the statements and voice recording files in the victim’s court and investigative agency as evidence.
C. In light of the following facts and circumstances acknowledged by the evidence duly adopted and examined by the court below and the court below, it is difficult to view that the evidence submitted by the prosecutor alone proves that the Defendant committed an indecent act against the victim (including indecent act by assault or intimidation) to the extent that there is no reasonable doubt.
Therefore, the judgment of the court below which found the Defendant guilty of the facts charged of this case is erroneous and adversely affected the conclusion of the judgment, and the above assertion is with merit
