A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant’s fraud against the Victim C, without the intent or ability to transfer the ownership of the land or pay money,
A. From October 2008 to the effect that “A victim C has a land registered in the name of Japanese person in Japan, and the principal owner does not exercise his ownership, so he would transfer his ownership to the party, as he would not transfer his land ownership to the party,” and that he remitted or received from the victim a sum of KRW 10 million in sum over several occasions around that time.
B. On September 1, 2011, at the coffee shop near Seongdong-gu, Seongdong-gu, Seoul, the victim made a false statement to the effect that “it is good to find early land, but no one person may consent to inheritance, and only KRW 200,000,000,000,000 should be lent to anyone, and if so, he/she would receive a loan from the inherited land, and he/she would receive a loan from the victim to repay all the borrowed money during that period, namely, KRW 20,00 from the victim;
C. On November 25, 201, the Plaintiff received KRW 1500,00 from the victim, i.e., delivery of KRW 1.5 million from the victim, i.e., e., the victim, on a reciprocal coffee shop located in Suwon-si, Suwon-si, with the purport that “on the face of China, a container with a death in China exists, and may be sold at the face of the fare.”
D. On December 7, 2011, the victim made a false statement to the effect that, “If the expenses of directors are leased to make a director at auction and hold a director at auction at the same time, he/she shall receive a transfer from the victim, i.e., e., KRW 270,000,000,000 from the victim’s seat, by taking over the land in his/her father’s name and making a loan to him/her.”
E. A certified judicial scrivener around February 27, 2012, who is on the victim’s 's chip at a mutually French shop near Seongdong-gu Seoul, Seongdong-gu.
