1. The Defendant shall have 10 square meters of a ground building on the part indicating brooms in the attached Form, among the area of 492.3 square meters in the 492 square meters prior to the Chungcheongbuk-gun C.

The Plaintiff completed the registration of ownership transfer on August 12, 2016 with respect to the land of 492.3 square meters (hereinafter “instant land”). The Defendant constructed a prefabricated-type building with a size of 10 square meters on the ground of the part indicating brooms of the attached Form among the instant land (hereinafter “instant building”) without any dispute between the parties, or may be recognized by adding the overall purport of the pleadings to the video of 5 No. 11 and 12, the video of 5 (including the paper number) and the statement of 11 and 12.

According to the above facts, the defendant, the owner of the building of this case, is obligated to remove the building of this case to the plaintiff, the owner of the building of this case, and deliver the land with the indication of brooms.

In regard to the building of this case, the defendant argued to the effect that the plaintiff or the former owner D, etc. of the land of this case have the right to possess the land of this case, but there is no evidence to acknowledge it. Thus, the defendant's above assertion is rejected.

Therefore, the plaintiff's claim is reasonable, and it is decided as per Disposition.
