A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

No person shall, in using and managing the means of access, borrow or lend the means of access or store, deliver or distribute the means of access with the knowledge that they are to be used for a crime or to be used for a crime.

Nevertheless, the Defendant, on December 2, 2019, sent an authorized certificate installed in the Defendant’s mobile phone to the Defendant’s name in the name of “B company” to the Defendant’s account number (D), and sent an authorized certificate to the Defendant’s bank to the Defendant’s computer in order to obtain a loan by creating a false transaction performance and raising credit rating, thereby obtaining a so-called “illegal work loan.” On December 2, 2019, the Defendant, despite having been urged to obtain a loan from the Defendant, provided that he/she would have obtained a loan by deceiving the bank. On December 2, 2019, the Defendant sent an authorized certificate installed in the Defendant’s mobile phone to the Defendant’s name Nonparty to the C bank account number (D), account password, and the password, and the authorized certificate number of the Defendant’s cell phone to the Defendant’s name Nonparty.

Accordingly, the Defendant lent the means of access knowing that it will be used for crime purposes or crime.
