1. As to the Plaintiff (Counterclaim Defendant)’s KRW 158,275,728 against the Defendant (Counterclaim Plaintiff) and its amount from September 28, 2016 to November 22, 2018.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. On July 6, 2015, the instant agreement was drafted, etc. (1) the Defendant (C corporation was merged on July 6, 2015).

A) Between D Co., Ltd. and D Co., Ltd. on February 2015, the “F hotel” (hereinafter “instant hotel”) on the land outside E and five parcels in Jeju Island.
(2) The Plaintiff entered into a contract for construction work with the term “G” as the contract price of KRW 28.38 billion for the new construction work (Evidence A No. 1, 2, 17-1, 2, 3). On March 3, 2015, the Plaintiff and the Defendant seeking to construct the instant hotel (hereinafter “instant agreement”) entered into an agreement relating to the said hotel interior work (hereinafter “instant agreement”).
However, the phrase “the construction works specified in Article 4 of the contract for construction works” attached to the above contract states that “the amount of construction works specified in the foregoing Article shall be the amount of the provisional contract, and shall be prepared to make a written estimate applying the selection of all finished materials and the scope of construction works before the commencement of the new construction works, and shall proceed with the construction works at the mutually agreed cost
