Defendant shall be punished by a fine of KRW 20,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a person who is a ship of the nationality of the Republic of Korea of the Republic of Korea who works as a travel agent in the Republic of Korea.

In order to export goods under the Customs Act, the name, size, quantity and price of the relevant goods, and other matters prescribed by Presidential Decree shall be reported to the head of a customs office, and in cases of exporting goods exceeding two million won in the limited price of the goods through international mail, the sender of the postal item shall file a fixed export declaration with the customs office.

그럼에도 불구하고 피고 인은 중 국내에서 한국산 화장품의 인기가 높고 특히 한국에서 구매되어 중국으로 반입된 한국산 화장품이 짝 퉁의 염려가 없어 인기가 높자 중국 여행 관광객을 모집하여 한국 시내 면세점에서 각종 할인 혜택을 받아 한국산 화장품을 대리 구매한 후 국제 특급우편 (EMS) 을 통하여 중국으로 밀수출 판매하여 그 차액이 득을 취할 마음으로, 중국 인터넷 채팅 사이트 ' 위 챗( 微信, we chat)' 을 통하여 면세점에서 한국산 화장품을 대리 구매할 중국인 관광객을 모집하여, 2015. 10. 7.부터 2016. 2. 6.까지 총 100명의 중국인 관광객 명의로 ㈜ 호텔 롯데 롯데 시내 면세점 3 곳에서 “ 설화 수 진설 2 종 세트” 등 각종 한국산 화장품 4,936점 한화 346,102,850원 상당을 대리 구매한 후, 이 중 일부는 국내판매하고 나머지 대리 구매 물품 중, 위 채팅사이트에서 알게 된 중 국내 구매자( 전화번호 : D)에게 한국산 화장품 ‘ 설화 수 진설 2 종 (15 설) 세트’ 5점 외 3 종 도합 20점, 한화 2,335,980원 상당의 각종 한국산 화장품을 판매 발송하기 위하여 2015. 10. 8. 국제 특급우편 (EMS) 송장번호 E 및 F를 통하여 중국으로 분산 발송함으로써 세관에 정식 수출신고함 없이 위 한국산 화장품 ‘ 설화 수 진설 2 종 (15 설) 세트’ 5점 외 3 종 도합 20점, 한화 2,335,980원 상당의 각종 한국산 화장품을 밀수출한 것을...
