1. 강제추행미수 피고인은 2019. 3. 29. 13:45경 인천 남동구 B 건물 1층 ‘C'에서, 피고인을 손님으로 착각하고 다가오는 피해자 D(여, 30세)을 갑자기 껴안아 피해자를 강제로 추행하려고 하였으나 깜짝 놀란 피해자가 도망을 가는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.

2. 특수폭행 피고인은 2019. 3. 29. 13:50경 위 1항 기재와 같은 건물 1층 분양사무실에 있는 여성에게 접근하려다가 그곳에 있던 피해자 E(44세)에게 발각되어 건물 밖으로 쫓겨나자, 그곳 건물 1층 ‘F' 식당의 후문 앞 복도에 있던 위험한 물건인 나무로 만든 끝이 뾰족한 양꼬치용 꼬챙이(길이 약 30cm) 여러 개를 한꺼번에 집어 들고 피해자의 목을 향해 찌르고, 피해자가 이를 손으로 막자 한 팔로피해자의 목을 감아 조르는 등 폭력을 행사하였다.
