Reasons
Punishment of the crime
[criminal power] On May 25, 2017, the Defendant was sentenced to a suspended sentence of six months for habitual night building intrusion and larceny in the Daegu District Court and the Defendant was sentenced to a suspended sentence of two years for six months. On January 18, 2018, the Seoul East East District Court sentenced a maximum of one year and eight months for larceny, etc. at the Seoul East District Court, which became final and conclusive on May 16, 2018, and the said suspended sentence was invalidated on March 1, 2019.
【Criminal Facts】
1. On April 6, 2019, the Defendant: (a) committed theft and intrusion upon a church and stolen cash from the “Crown-gu, Mayang-si; (b) intrudes into the first floor office through the door in which the church is opened; (c) had cash of KRW 700,000 owned by the victim D; and (d) had and stolen money from around that time until around April 24, 2019, the Defendant stolen KRW 1,105,000 owned by the victims by the same method four times in total, such as the list Nos. 1, 2, 3, and 10 of the annexed crime list, from that time until April 24, 2019.
Accordingly, the defendant invadedd on the structure managed by others, and stolen the victims' property.
2. At night, around 21:00 on April 12, 2019, the Defendant: (a) went after a church and stolen cash; (b) went through a door in which the church is opened; and (c) taken off 20,000 won of cash owned by the victim from a household mobile phone case inside the bank where it was located at the same time, and cut off 20,000 won of cash owned by the victim; and (d) from around that time to April 2:30, 2019, the Defendant stolen 350,000 won in cash owned by the victims by the same method three times in total, such as the list Nos. 4, 6, and 9 of the crimes committed during the period from that time to April 19, 2019.
Accordingly, the defendant invadedd a structure managed by others at night, and stolen the victims' property.
3. The Defendant who attempted to larceny at night buildings shall be located in Dongdaemun-gu Seoul, Dongdaemun-gu, around 19:50 on April 17, 2019.
