The defendant's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal does not contain any injury to the victim’s body, as in the facts charged in this case, when the victim’s body head is cut and haired, or when the victim’s left hand knife is broken.
2. In light of the difference between the first instance court and the appellate court’s method of evaluating the credibility of a witness’s statement in light of the substance of the first instance judgment and the evidence duly examined by the first instance court, or the first instance court’s determination on the credibility of a witness’s statement in light of the contents of the first instance judgment and the evidence evidence duly examined by the first instance court, unless there are exceptional circumstances where it is clearly deemed that maintaining the first instance court’s determination on the credibility of a witness’s statement by the first instance court’s result of examination and the date of closing argument in the appellate court is considerably unreasonable, the appellate court should not reverse the first instance court’s determination on the grounds that the first instance court’s determination on the credibility of a witness’s statement by the first instance court is different from the appellate court’s determination (see, e.g., Supreme Court Decision 2011Do5313, Jun. 14, 2012). In light of the aforementioned legal principles, the Defendant, based on public health care and the evidence testimony of the first instance court, following the witness’s testimony or its reasoning.
